Age Discrimination Laws - Minister Comments on Interpretation

Following the much publicised Age Discrimination laws coming into effect on the 1st October 2006, it is inevitable that Employers and Recruitment Agencies will be unclear as to the implications and interpretation of the new legislation.

The Recruitment Industry Trade Press interviewed Jim Fitzpatrick (Employment Relations Minister) recently on the implications for Agencies/Employers both prior and subsequent to October 1st to ensure compliance.

Mr Fitzpatrick was reported as providing the following guidance:

Recruitment Agencies should review all Practices and remove any age discrimination that cannot be justified
While age discrimination is no more acceptable than other forms of discrimination the Government recognises differential treatment due to age can sometimes be justified
The new regulations do not dictate that the dates of birth be removed from CV's but that employers do not discriminate on this basis
No specific words have been 'outlawed' however certain adjectives should not be used as a proxy for age
Mr Fitzpatrick believed that Recruitment Consultants have an important role in ensuring that competition for jobs is fair and does not favour candidates because of their age.
